Waste Collection Swiss Cottage Terms and Conditions
These Terms and Conditions set out the agreement between Waste Collection Swiss Cottage, referred to as we, us or our, and the customer, referred to as you or your, for the provision of waste collection and related services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means any waste collection, removal, loading, transportation, disposal, recycling, or related service provided by us.
Booking means a request by you for us to provide the Service, whether made online, by telephone, in writing, or in person.
Waste means any rubbish, refuse, junk, household items, commercial waste, garden waste or other materials presented by you for collection.
Site means the premises or location where the Waste is to be collected or where the Service is to be performed.
2. Scope of Services
We provide waste collection and related services for domestic and commercial customers in Swiss Cottage and surrounding areas. The specific nature and scope of the Service, including the type and approximate volume of Waste to be collected, access arrangements, and timing, will be agreed with you at the time of Booking.
All Services are subject to these Terms and Conditions, applicable UK law, and any local regulations relating to waste management and environmental protection. We reserve the right to refuse to collect any items that are prohibited, hazardous, unsafe, illegal, or unsuitable for collection or transport.
3. Booking Process
You may request a Booking by contacting us using our published contact details. When you make a Booking, you must provide accurate and complete information, including the Site address, contact details, description and approximate quantity of Waste, any access restrictions, and preferred date and time for collection.
Your Booking constitutes an offer to purchase the Service. We may accept or refuse any Booking at our sole discretion. A contract between you and us is formed when we confirm acceptance of your Booking, whether verbally, in writing, or by email. We may provide an estimated arrival window for our team, which is indicative only. We will use reasonable efforts to attend within the agreed time frame but do not guarantee exact times.
We rely on the information you provide at the time of Booking. If on arrival the actual volume, weight, type of Waste or access conditions differ significantly from what was described, we may adjust the price, modify the Service, or decline to provide the Service. Any variation must be agreed with you before we proceed.
4. Access and Customer Responsibilities
You are responsible for ensuring that our team has safe, reasonable and uninterrupted access to the Site and the Waste for the duration of the Service. This includes providing accurate access instructions, arranging necessary permissions, ensuring that communal or restricted areas can be entered, and ensuring that the Waste is ready for collection.
You must ensure that the Site is safe and suitable for our personnel and vehicles, and that there are no health and safety hazards, including dangerous structures, aggressive animals, exposed wiring, or hazardous substances not disclosed in advance. We may refuse to work in any conditions we consider unsafe.
You confirm that you are either the owner of the Waste and the Site or have the full authority and consent of the owner or occupier to arrange the Service. You agree to indemnify us against any claims from third parties alleging that we did not have permission to access the Site or remove the Waste.
5. Pricing and Quotations
Prices for our Services are generally based on the type and estimated volume or weight of Waste, labour required, access difficulty, and disposal or recycling costs. We may provide you with a guide price or quotation before the Service. Any quotation is based on the information you provide and is not final until our team assesses the Waste on arrival.
On arrival at the Site, we will confirm the final price for the Service based on the actual Waste and Site conditions. If the final price differs from any earlier estimate, we will explain the difference. If you do not agree to the updated price, you may decline the Service and no work will be carried out, save for any applicable call-out charge that we have expressly notified to you in advance.
6. Payments and Invoicing
Unless otherwise agreed in writing, payment is due in full on completion of the Service and prior to departure of our team from the Site. We may accept payment by cash, card or other methods as we make available from time to time.
For commercial customers or larger projects, we may agree alternative payment terms, including deposits, staged payments or payment on invoice. Such arrangements must be agreed in advance. Where payment is made on invoice, the payment due date will be stated on the invoice, and time for payment shall be of the essence.
If you fail to make any payment when due, we may charge interest on the overdue amount at the maximum rate permitted by applicable law until payment is made in full. We may also suspend or refuse further Services until all outstanding sums are settled.
7. Cancellations and Rescheduling
You may cancel or reschedule your Booking by contacting us as soon as reasonably possible. We understand that plans change, but we reserve the right to apply charges for late cancellations or repeated rescheduling.
If you cancel a Booking more than 24 hours before the agreed arrival time, any deposit already paid may be refunded or applied to a future Booking at our discretion. If you cancel within 24 hours of the agreed arrival window or fail to provide access to the Site when our team attends, we may charge a cancellation fee or call-out fee to cover costs incurred.
We may cancel or reschedule the Service at any time if circumstances beyond our reasonable control arise, including severe weather, vehicle breakdown, staff illness, accidents, traffic disruption, legal restrictions, or safety concerns at the Site. We will notify you as soon as reasonably practical and offer an alternative appointment. We will not be liable for any loss arising from such cancellation or delay, subject to your statutory rights.
8. Waste Types and Prohibited Materials
Our Service covers general household, commercial, garden and bulky Waste, subject to applicable waste management regulations. Certain materials are subject to special controls or may not be collected by us, including but not limited to hazardous waste, clinical or medical waste, asbestos, chemicals, solvents, oils, gas cylinders, explosives, radioactive materials, and any material classified as dangerous under UK law.
You are responsible for informing us at the time of Booking of any items that may be classified as hazardous or require special handling. We reserve the right to refuse to collect any Waste which we reasonably believe to be hazardous, illegal, contaminated, or unsuitable for our Service.
If we discover prohibited or hazardous materials during the Service, we may cease work immediately and you may be responsible for any additional costs incurred, including safe disposal and any legal or regulatory obligations that arise.
9. Waste Handling, Transport and Disposal
We will handle, load, transport and dispose of Waste in accordance with applicable UK waste regulations and our duties as a waste carrier. We will take reasonable steps to divert Waste from landfill where recycling or recovery options are available and commercially feasible.
Once the Waste has been loaded into our vehicle and removed from the Site, ownership and responsibility for the Waste will transfer to us. You confirm that the Waste is not subject to any third-party rights or disputes and that it is lawful for the Waste to be disposed of or recycled.
We do not guarantee that any particular item will be recycled or reused, but we will act responsibly and in compliance with applicable environmental regulations, permits and duty of care requirements.
10. Customer Property and Preparation
Before the Service takes place, you must remove any personal belongings, valuables, or items not intended for disposal from the area where we will be working. We are not responsible for items that are removed and disposed of as Waste if they were left with or among the Waste or not clearly separated or identified.
You should ensure that access routes are clear and that any fragile items or surfaces near the work area are removed or protected. While we take reasonable care when carrying out the Service, minor scuffs or marks can occasionally occur during the movement of bulky items, and we will not normally be liable for such minor cosmetic damage.
11. Liability and Limitations
We will exercise reasonable skill and care in providing the Service. If we cause direct physical damage to your property due to our negligence, we will either repair the damage or compensate you for the reasonable cost of repair or replacement, subject to the limitations of this section.
Our total liability to you arising out of or in connection with the Service, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable for the Service that gave rise to the claim, except where such limitation is not permitted by law.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
We are not liable for any indirect, consequential, special or economic loss, including loss of profit, loss of business, loss of opportunity, or loss of data, arising from or in connection with the Service. We are also not responsible for any delays or failures in performance caused by events beyond our reasonable control.
12. Complaints and Disputes
If you have a concern or complaint about the Service, you should contact us as soon as possible with details of the issue. We will investigate your complaint and aim to respond promptly. In many cases, issues can be resolved quickly if raised at or shortly after the time of the Service.
Any claim relating to damage to property or dissatisfaction with the Service should be notified to us within a reasonable time and accompanied by evidence such as photographs or invoices for repair. Delayed notification may affect our ability to investigate and resolve the matter.
13. Data Protection and Privacy
We may collect and process personal data about you for the purpose of managing Bookings, providing the Service, handling payments, and communicating with you. We will handle your personal information in accordance with applicable data protection laws. By using our Service, you consent to such processing for these purposes.
We may retain your details for a reasonable period after the Service to comply with legal obligations, maintain records, and respond to any queries or disputes. You have certain rights in relation to your personal data, which you can exercise by contacting us.
14. Changes to These Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice, or our business operations. Any revised terms will apply to Bookings made after the date the updated version is published or notified to you. The Terms and Conditions in force at the time of your Booking will apply to that Booking.
15. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17. Entire Agreement
These Terms and Conditions, together with any written confirmation of your Booking and any agreed variations, constitute the entire agreement between you and us in relation to the Service and supersede any previous agreements, understandings or arrangements, whether written or oral, relating to the same subject matter.
By making a Booking or using our waste collection services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
